Mobile Artiste of the Year nominees & winner criteria

§  This category nomination is open to all Malaysian artistes who has locally produced album & released in between 1st January 2009 until 30th June 2010.
§  All local music labels will send in their list of nominees which will consists of top songs registered under their company. The nomination will be based on number of mobile downloads of the nominated songs.
§ The number of mobile downloads will be generated from Celcom, UMobile and Digi downloads
§  Top 40 nominated songs with release-to-date highest downloads will be featured on Channel X and Shout! Awards website.
§  Top 5 artistes will be shortlisted by 11th October 2010 to be announced on 15th October 2010. These 5 artistes will be the one to compete to be the “Mobile Artiste of the Year”.
§  Winner of the category will be based on number of mobile downloads achieved until 15th November 2010.
§  Winner of this category will be announced during the Shouts! Award on the 20th November 2010.

Term

The Ring Back Tone Subscription (the RBT Subscription) is opened to ALL Malaysian residents who have access to or are pre-paid and post-paid mobile phone subscribers of Maxis, DiGi,  UMobile & Celcom (hereinafter referred to as "Participating Telecommunication Operators"). The RBT Subscription will run for any other period as may be notified by 8TV (hereinafter referred to as "the Subscription Period"). "Subscriber" shall mean an individual who has registered and subscribed in the RBT Subscription in accordance with the terms and conditions set out herein.

To participate in the RBT Subscription, Subscriber will be charged for the use of this service monthly as well as for purchases of content of this Service at the applicable rates stated and published from time to time. Participating Telecommunication Operators reserves the right to amend these rates (without prior notice) at any time for any of the Services. Any amendments in relation to fees will be effective from the date it is published on this Site or such other dates as may be stipulated. Subscribers further agree that rates applicable for the RBT service will be dependent on the content and such charge shall be automatically applicable.

Subscribers must ensure that their account as a Pre-paid or Post-paid subscriber is "Active" to subscribe the RBT. "Active" means that for Post paid accounts there are no outstanding balances as at the date the Subscribers subscribe the RBT and as for Pre-paid account, there are talk-time credits still remaining in the account. 8TV reserves the right to change/amend, add or alter the Terms and Conditions herein from time to time and without prior notification.

The Subscriber is provided on an as is where is available basis. 8TV will not be responsible and will not be liable if any SMS messages cannot be delivered due to connection issues arising from out of coverage areas, traffic congestions et cetera. Proof of SMS messages sent is no proof that the messages were duly received. Only SMS messages that were acknowledged received are valid (Acknowledgement will be made by the participating telecommunication providers through an SMS prompt or reply). Neither the Participating Telecommunication Operators, the content information providers, Alt Media Sdn Bhd, Media Prima Sdn Bhd, Sistem Televisyen Malaysia Berhad and any other affiliates of this RBT Subscription shall be liable in any way for delays or interruptions in providing the information or omissions therein. 8TV and the Participating Telecommunication Operators shall not be responsible and liable for any unauthorized use of the mobile phone or subscriber's account in relation to this RBT Subscription.

Persons below 18 are required to get the Parents or Guardian's consent to participate in this RBT Subscription. None of the foregoing parties shall be liable for any third-party claims or loses of any nature, including but not limited to, lost of profits, punitive, indirect, special, incidental, or consequential damages or for other damages. None of the foregoing parties shall be responsible or be held liable for any system, server or connection failure, interruption and delay or computer viruses, and any related claims of any nature, including direct, indirect, third party, consequential or other damages. By participating in this RBT Subscription, the Subscriber is taken to have read and agreed to the terms and conditions herein and all decisions made by 8TV.
